As of the Voice's press time on Wednesday morning, no decisions had been made regarding the lawsuit challenging the legality of Mountain View-Whisman School District's $1.6-million parcel tax election.

A Santa Clara County Superior Court judge is reviewing the case and is slated to hand down a ruling any day.

Aaron Katz, a Saratoga resident, sued the school district and the county elections office, claiming the March 2 election was run unconstitutionally because property owners, who did not live within the district's boundary, were not allowed to cast a vote.

Katz, through a partnership, owns 10 condos in the district but does not live in Mountain View and was not allowed to vote on the measure. Since the tax passed with 69 percent of the vote, Katz said he will have to pay $750 annually for the new tax.
