Three sentenced in gang-related stabbing

Three members of a Norteno gang from Mountain View have been sentenced in last year's stabbing death of Mario Aguilar, an 18-year-old San Jose man, according to officials from the district attorney's office. Three others members of the same gang are scheduled to be sentenced next month in connection with the incident.

Jose Rodriguez, Timothy Segovia and Alberto Villarreal were sentenced Friday, Oct. 8, at the Hall of Justice in San Jose for their roles in the July 12, 2009, stabbing, according to Amy Cornell, public information officer for the Santa Clara County District Attorney's Office.

All three plead no contest to the charge of assault with intent to cause great bodily harm with a gang enhancement that adds to the sentence. Villareal will serve four years, Rodriguez will serve seven years and Timothy Segovia was sentenced to seven years and eight months.

The other gang members, John Macais, Luis Orozco and Charlotte Rapuet are scheduled to be sentenced on Nov. 5, Cornell said.

Orozco is expected to be sentenced to 23 years and eight months for voluntary manslaughter, use of a deadly weapon and a gang enhancement, according to Cornell. Macais is expected to receive a sentence of 18 years and eight months for voluntary manslaughter with a gang enhancement, and assault with a deadly weapon with a gang enhancement.

Rapuet is expected to sentenced to one year of prison for accessory to a felony with a gang enhancement and a probation violation, Cornell said.

The stabbing occurred in the midst of a fight, which took place after a 16-year-old girl's birthday party in Sunnyvale on the 900 block of Bluebell Way, Cornell said.
