A Hells Angels member is looking at several years in state prison for punching a man in the back of the head during a Chris Stapleton concert at Mountain View’s Shoreline Amphitheatre in 2022. The man suffered a traumatic brain injury and later died.

Logan Winterton, 40, reached a deal with the Santa Clara County District Attorney’s Office last month to plead no contest to voluntary manslaughter in the death of 41-year-old Juan Gonzalez, as well as to a felony assault charge related to an altercation with an off-duty police officer earlier that night, according to court documents.

Taken together, the maximum sentence would be 12 years in state prison, the documents said. However, as part of the plea deal, Winterton is looking at half that time, pending a judge’s approval at an Aug. 5 sentencing hearing, Winterton’s attorney Brian Getz said. 

“He agreed to the plea deal because he wanted to accept responsibility for his blameworthiness,” Getz told the Voice. “He wanted to acknowledge wrongdoing in punching this person.”

The deal, which both parties signed off on last month, was based on the “mitigating and aggravating facts specific to the offenses,” district attorney’s office spokesperson Sean Webby wrote to the Voice. 

Originally, prosecutors charged Winterton with murder for Gonzalez’s death. However, Getz said that the prosecution and defense agreed that this was an “overcharge” given that Winterton punched Gonzalez a single time and didn’t intend to kill him.

The fatal incident occurred on June 18, 2022 during a country music concert. At around 10:40 p.m., several Hells Angels motorcycle club members were gathered near the amphitheater’s Stage Right Cafe, when Gonzalez came up and touched the shoulder of a member’s girlfriend, according to a police report. 

As Gonzalez walked away, Winterton came up from behind and delivered a single punch to the back of his head, causing Gonzalez to fall face first into the concrete, the report said. Gonzalez was treated on scene and then transported to the hospital, where it was determined he had no brain activity. He was taken off life support on June 29.

Earlier in the night, Winterton was also involved in the assault of an off-duty police officer, the report said. An unidentified Hells Angels member punched the officer in the face, causing him to fall to the ground. While he was down, Winterton and other club members were seen kicking and punching the officer, the report said.  

An ambulance transported the officer to a local hospital, where he was treated for a broken orbital bone, discoloration to his eyes, loss of consciousness and significant facial swelling, according to the report.
