The father of a 9-year-old boy who drowned in a pool two years ago filed a $10 million claim against the city of Mountain View in September, alleging that he was wrongfully charged, arrested and incarcerated for child endangerment after his son’s death.

In a 6-0-1 vote, the City Council rejected the claim during a closed session meeting on Oct. 22.

Pedro Rivera De Leon faced charges of felony child endangerment after his son, Ayden Rivera Gonzalez, drowned in his apartment complex pool in 2022. Last August, all the charges against Rivera were dismissed by the Superior Court of Santa Clara County, according to the claim.

The claim, which is filed against city officials and police officers, alleges malicious prosecution, false arrest and imprisonment, intentional infliction of emotional distress, abuse of process, defamation and battery. It describes other injuries as well, like pain and suffering, loss of reputation, financial losses, fear and anxiety and loss of friendships.

This is not the first time Rivera has filed a claim against the city. In September 2022, Rivera and the boy’s mother each filed a wrongful death claim, seeking $7.6 million for emotional distress and other damages. The city denied both claims at the time.
